AddisToday Terms of Service

Thank you for using AddisToday! We're committed to making event discovery and community connection in Addis Ababa accessible, safe, and enjoyable for everyone.

When we say "Company," "we," "our," or "us" in this document, we're referring to AddisToday.

When we say "Services," we mean our website, mobile applications, and any product created and maintained by AddisToday, including addistoday.com and any related services or features.

When we say "You" or "your," we mean the person or organization using our Services.

These Terms of Service ("Terms") apply to your access and use of AddisToday's Services. By accessing or using our Services, you agree to be bound by these Terms. If you don't agree to these Terms, please don't use our Services.

We may update these Terms from time to time. When we do, we'll notify you through the Services or by email. Your continued use of the Services after such notification constitutes acceptance of the updated Terms.

Account Terms

Account Creation

  1. Eligibility: You must be at least 13 years old to use our Services. If you're under 18, you must have your parent or legal guardian's permission.

  2. Account Information: When you create an account, you may be asked to provide:
    - Email address (required)
    - Ethiopian phone number (optional but recommended for verification)
    - Username (auto-generated from your email if not provided)
    - Profile information (optional)

  3. Account Security: You are responsible for:
    - Maintaining the security of your account credentials
    - All activities that occur under your account
    - Not sharing your account access with others
    - Notifying us immediately of any unauthorized use

  4. Verification: We may require email or phone verification for certain features, including creating events, posting reviews, or becoming an event organizer.

  5. One Account Per Person: You may only create one account. Creating multiple accounts for fraudulent purposes is prohibited.

Account Responsibilities

  1. You are responsible for all content posted and activity that occurs under your account.

  2. You may not use our Services for any illegal or unauthorized purpose, including but not limited to those outlined in our Acceptable Use Policy.

  3. You must not transmit any malicious code, worms, viruses, or any destructive nature.

  4. You must provide accurate and truthful information when creating listings, events, or experiences.

User Roles and Permissions

Regular Users (Attendees)

As a regular user, you can:
- Browse events, experiences, and places in Addis Ababa
- Save favorite events
- Submit reviews and ratings
- Send inquiries to event organizers
- Receive personalized event recommendations

Event Organizers and Creators

Event organizers have additional permissions:
- Create and manage event listings
- Create and manage experiences
- Respond to attendee inquiries
- Access analytics for their events

Becoming an Organizer: You can request organizer status through your profile settings. We may verify your identity or require additional information before granting organizer permissions.

Organizer Responsibilities: As an organizer, you agree to:
- Provide accurate event information (dates, times, locations, pricing)
- Respond to attendee inquiries in a timely manner
- Honor all published event details and commitments
- Comply with all applicable local laws and regulations for events in Addis Ababa
- Not misrepresent your events or services

Event Listings and User-Generated Content

Your Content

  1. Ownership: You retain all ownership rights to content you create or upload to our Services, including:
    - Event listings and descriptions
    - Experience details
    - Reviews and comments
    - Profile information and images
    - Messages and inquiries

  2. License to AddisToday: By posting content to our Services, you grant us a worldwide, non-exclusive, royalty-free license to:
    - Display, reproduce, and distribute your content on our Services
    - Use your content for promotional purposes (event listings on our homepage, social media, etc.)
    - Make derivative works necessary to provide the Services (e.g., resizing images, creating thumbnails)

This license ends when you delete your content or close your account, except for content that has been shared by others.

  1. Content Standards: All content you post must:
    - Be accurate and not misleading
    - Not infringe on others' intellectual property rights
    - Not contain illegal or harmful material
    - Comply with our Acceptable Use Policy
    - Not contain spam, malware, or deceptive elements

Event Listing Requirements

For event listings to be published on AddisToday, they must:

  1. Be Real Events: All listed events must be actual events happening in or around Addis Ababa.

  2. Accurate Information: Include accurate details about:
    - Event date, time, and location
    - Pricing (if applicable)
    - Event description and what attendees can expect
    - Contact information for inquiries

  3. Appropriate Content: Not contain:
    - Adult content (unless properly labeled and age-restricted)
    - Hate speech or discriminatory content
    - Violent or graphic content
    - Misleading or deceptive information
    - Spam or commercial advertisements unrelated to the event

  4. Proper Categorization: Be listed in the appropriate category.

Content Moderation

  1. Review Process: We reserve the right to review all content before it appears on our Services. Event listings may have the following statuses:
    - Draft: Visible only to you
    - Pending: Under review by our team
    - Active: Published and visible to all users
    - Inactive: Temporarily hidden
    - Rejected: Did not meet our standards

  2. Moderation Rights: We reserve the right to:
    - Remove or refuse to publish any content
    - Suspend or terminate accounts that violate these Terms
    - Modify content for formatting or clarity (with your permission)
    - Feature or promote certain events on our platform

  3. No Obligation: We have no obligation to monitor user content, but we may do so at our discretion.

Reviews and Ratings

  1. Honest Reviews: Reviews must be based on genuine experiences and provide honest feedback.

  2. Prohibited Review Practices:
    - Posting fake or fraudulent reviews
    - Reviewing your own events or experiences
    - Posting reviews in exchange for compensation
    - Including personal attacks or harassment

  3. Review Moderation: We review all submissions before publishing them. We may reject reviews that:
    - Contain profanity or offensive language
    - Include personal information
    - Are not constructive or relevant
    - Violate our Acceptable Use Policy

Payment and Pricing

Current Status

Important: AddisToday currently does not process payments directly. Event organizers are responsible for handling their own ticketing and payment collection through their preferred methods.

Future Payment Features

If we implement payment processing in the future:

  1. Transaction Fees: We may charge fees for facilitating transactions. Any fees will be clearly disclosed before you complete a transaction.

  2. Payment Processing: Payments will be processed through third-party payment providers (such as Chapa). Your payment information will be handled according to their terms and privacy policies.

  3. Refunds: Refund policies will be determined by individual event organizers. We may establish platform-wide refund guidelines once payment processing is implemented.

  4. Taxes: You are responsible for determining and paying any applicable taxes for your use of the Services.

Cancellation and Termination

Your Rights to Cancel

  1. Account Deletion: You can delete your account at any time through your account settings.

  2. Effect of Cancellation:
    - Your profile and content will be immediately removed from public view
    - We will delete your personal data within 60 days, except where we're legally required to retain it
    - Your published event listings will be removed
    - Your reviews may remain published (anonymized) to maintain integrity of our review system

Our Rights to Suspend or Terminate

We reserve the right to suspend or terminate your account:

  1. If you breach these Terms or our Acceptable Use Policy
  2. If we suspect fraudulent, abusive, or illegal activity
  3. If required by law or legal process
  4. At our sole discretion, for any reason, with or without notice

Effect of Termination

Upon termination by us:
- You will lose access to your account and all associated content
- We may retain certain data as required by law or for legitimate business purposes
- You may not create a new account without our permission

Intellectual Property Rights

Our Rights

  1. Service Ownership: AddisToday owns all right, title, and interest in and to the Services, including:
    - The AddisToday website and mobile applications
    - AddisToday branding, logos, and trademarks
    - Source code, software, and design elements
    - Curated content and editorial selections

  2. Restrictions: You may not:
    - Copy, modify, or create derivative works of our Services
    - Reverse engineer or decompile our software
    - Use our trademarks without permission
    - Reproduce, duplicate, or reuse any HTML, CSS, JavaScript, visual design elements, or other code from our Services without explicit permission
    - Scrape or use automated tools to extract data from our Services

Your Rights

  1. You retain ownership of all content you create and upload
  2. You may export your content at any time before deleting your account
  3. You may request deletion of your content at any time

Copyright Infringement

If you believe content on our Services infringes your copyright:

  1. Send a notice to: legal@addistoday.com
  2. Include:
    - Description of the copyrighted work
    - URL where the infringing content appears
    - Your contact information
    - Statement that you have a good faith belief the use is unauthorized
    - Statement that the information is accurate and you're authorized to act
    - Your physical or electronic signature

We will investigate and take appropriate action, which may include removing the content and/or terminating the offending user's account.

Geographic Scope and Local Laws

Addis Ababa Focus

AddisToday is designed specifically for events and activities in Addis Ababa, Ethiopia. While we welcome users from anywhere, our primary focus is serving the Addis Ababa community.

Compliance with Local Laws

  1. Event Organizers: If you're organizing events in Addis Ababa, you are responsible for:
    - Obtaining all necessary permits and licenses
    - Complying with Ethiopian laws and regulations
    - Following local ordinances and venue requirements
    - Ensuring events meet health and safety standards

  2. Platform Compliance: We operate our Services in compliance with applicable Ethiopian laws and international regulations, including GDPR for EU users.

Jurisdiction

  1. These Terms are governed by the laws of Ethiopia and the Federal Democratic Republic of Ethiopia.

  2. Any disputes arising from these Terms or your use of the Services will be resolved in the courts of Addis Ababa, Ethiopia.

  3. If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full effect.

Privacy and Data Protection

    - Event information provided by organizers is accurate

  3. Service Changes: We may:
    - Modify or discontinue features at any time
    - Perform maintenance that temporarily limits access
    - Update our technical infrastructure

We'll try to provide notice of significant changes, but we're not obligated to do so.

Service Limitations

  1. Content Accuracy: We don't verify all event information. Event organizers are responsible for accuracy.

  2. Event Issues: We are not responsible for:
    - Event cancellations or changes
    - Quality of events or experiences
    - Disputes between attendees and organizers
    - Refunds or compensation (unless we process the payment)

  3. Technical Issues: We are not liable for data loss, service interruptions, or technical problems beyond our reasonable control.

Service Uptime

While we strive for high availability, we don't guarantee 100% uptime. Scheduled maintenance and unexpected technical issues may occur.

Limitation of Liability

Maximum Liability

To the fullest extent permitted by law:

  1. No Consequential Damages: We are not liable for any indirect, incidental, special, consequential, or punitive damages, including:
    - Loss of profits or revenue
    - Loss of data or content
    - Loss of business opportunities
    - Costs of substitute services

  2. Direct Damages Cap: Our total liability for any claims arising from your use of the Services is limited to the greater of:
    - The amount you've paid us in the past 12 months, or
    - 100 USD / 5,000 Ethiopian Birr

  3. Exceptions: Nothing in these Terms limits our liability for:
    - Fraud or fraudulent misrepresentation
    - Death or personal injury caused by our negligence
    - Any liability that cannot be excluded by law

Your Responsibilities

You agree to indemnify and hold harmless AddisToday, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  1. Your violation of these Terms
  2. Your violation of any rights of another person or entity
  3. Content you post or events you organize
  4. Your use or misuse of the Services

Third-Party Services and Links

Third-Party Integrations

Our Services may integrate with or link to third-party services, including:

  • Analytics: Google Analytics 4, Microsoft Clarity
  • Social Media: Facebook, TikTok (via pixels)
  • Cloud Storage: Cloudflare R2
  • Email: Email service providers
  • Payment: Chapa (when payment features are implemented)

Your use of these third-party services is governed by their respective terms and privacy policies. We're not responsible for their practices or content.

External Links

We may include links to third-party websites or event booking platforms. We don't endorse or assume responsibility for any third-party content, websites, or services.

Dispute Resolution

Communication First

If you have a concern or dispute with us:

  2. Provide a clear description of the issue
  3. Allow us a reasonable time to respond and resolve the matter

Most disputes can be resolved through direct communication.

Informal Resolution

We encourage informal resolution of disputes before pursuing legal action. We're committed to working with you in good faith to resolve any issues.

Formal Proceedings

If informal resolution fails:

  1. Disputes will be handled according to Ethiopian law
  2. Courts in Addis Ababa, Ethiopia will have exclusive jurisdiction
  3. You agree to submit to the personal jurisdiction of these courts

Miscellaneous

Entire Agreement

These Terms, along with our Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and AddisToday regarding the Services.

Waiver

Our failure to enforce any provision of these Terms doesn't constitute a waiver of that provision or any other provision.

Severability

If any provision is found invalid or unenforceable, the remaining provisions will remain in effect.

Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations without restriction.

Language

These Terms are written in English. If we provide a translation, the English version will govern in case of any conflict.

Updates and Notifications

  1. Policy Updates: We'll notify you of significant changes to these Terms via:
    - Email to your registered address
    - Notice on our website
    - In-app notification

  2. Service Notifications: We may send you service-related emails regarding your account, events you've created or saved, or important platform updates. You cannot opt out of these essential communications.

Beta Features

We may offer beta or experimental features. These are provided "as is" with no warranties, and we may discontinue them at any time.
